  • $250,000 settlement of a rear end collision. Client was a commercial truck driver parked at a stop light in Monett, Missouri when he was rear ended by a semi truck. Client sustained injuries to his head and neck but was able to continue his employment. This case settled in mediation after extensive discovery.
  • $225,000 workers compensation settlement. The deceased was driving when he swerved off the roadway and hit a tree. The issue was whether the deceased had a heart attack (non compensable) or was killed by the impact with the tree (compensable). The case was settled at mediation with the assistance of a number of expert witnesses.
  • $125,000 workers compensation settlement. Client was seriously injured when a tire he was airing up exploded. He sustained injuries that made it difficult for him to resume work activities. This case was settled at mediation.

His past medical bills were $122,754. Client did have pre-accident diagnosis of attention deficit hyperactivity disorder.   • $732,000 settlement for plaintiff- Our client was injured when he stopped his car on Highway 60 in Monett to wait for traffic to clear in order to make a left turn. He was rear-end by a vehicle that was rear-ended by a semi truck. The tractor trailer truck was owned by a company in Tennessee. This chain reaction was a direct result of his injuries. His diagnosis were: concussion, cluster headaches, Chiari malformation, strain to cervical and lumbar spine. His impotence was determined to be from a damaged pituitary gland as a result from his closed head injury. He required testosterone injections every 3 weeks. Experts used: accident reconstructionist, neuropsychologist, economist, vocational rehabilitation.
  • $ 382,000 settlement for plaintiff Our 17 year old client was driving a company truck in Lawrence County. The accident report reflects both vehicles crossed the center line and hit head-on. He suffered multiple fractures to his jaw requiring surgery to implant 14 teeth. His symptoms of poor memory and concentration were a result of his head injury. He fractured both ankles and tore his posterior cruciate ligament in his knee. His future medical care was estimated to be $245,000 for a possible fusion of his ankles, scar revisions. The defendant driver's insurance settled for $85,000 while the owner of the car she was driving settled for $275,000. The worker's compensation insurance was reimbursed $16,291 for a portion of expenses they paid.
  • $76,000 settlement for plaintiff. My client was a passenger in a car involved in a 4 car chain reaction accident on Highway 39 South of Aurora. She was airlifted from the scene where she received treatment for fractures of her spine, clavicle, scapula, arm and leg. She also has a head injury with bleeding into the brain. Her medical bills were over $40,000 paid by Medicaid. Upon settlement, Medicaid was reimbursed approximately $1,600. The defendant driver was uninsured. The maximum limits were obtained from the uninsured motorist policy of the owner of the car of which she was a passenger. The maximum limits were obtained from two uninsured motorist insurance policies from the homeowner where she resided.
  • $350,000 settlement for plaintiff My client proceeded thru the intersection of Highway 60 and 39 in Aurora. She was broadsided by a semi-trailer running. There was a dispute over who had the green light. My client was ejected from the vehicle resulting in the following injuries: fractures to her jaw, clavicle, iliac crest and five fractured ribs. She also had a 14 inch laceration from the corner of her mouth down to her throat. This almost completely removed her tongue. She had a collapsed lung requiring a respirator, a bruised kidney and a head injury. She was airlifted from the scene and received $147,790 in medical expenses. Medicare was reimbursed $36,410 of that expense. Expert used: neuropsychologist. Client agreed to a structured settlement.
  • $300,000 settlement for plaintiff My client was a passenger in a van that was driven by an un-owned driver. When the van topped a hill on a curve, it ran off the road and hit a tree. The driver was charged with a DWI. My client received fracture of his femur and hand. He required surgery to place a steel rod in his leg. His medical bills were $45,391. He did not have insurance and did not qualify for governmental assistance. Our office was able to obtain bill reductions from 10 - 40% on outstanding bills. Maximum insurance coverage was obtained from the owner of the van, driver of the car and from an insurance policy where the driver resided.
  • $170,000 settlement for plaintiff My client sold an antique vehicle . The buyer hired a car transport company to deliver the vehicle from Aurora to California . My client relied on the directions of the transport employee of loading the vehicle. At the top of the ramp, he was directed to pull forward. The auto went over the front and flipped over landing on its top trapping my client. He suffered a fractured clavicle, injury to his neck and arm along with a closed head injury. His medical expenses were $44,304. He was required to reimburse $2,508 for services received. This case was settled in mediation.
  • $85,000 settlement for plaintiff My elderly client was struck by a van backing out in the Ramey parking lot in Aurora. The impact caused her to fall breaking her hip. She required a hip replacement and developed a blood clot in her leg during her recovery. Her medical expenses were$35,080. She was required to reimburse Medicare $6,950 for services received. The case was settled in mediation.
  • $70,000 settlement for plaintiff My client was 64 year old driving on 60 Highway on the West side of Springfield. The collision occurred when the defendant pulled out in front of my client. As a result of the impact, he suffered neck strain, broken ribs, sacroilitis and a torn rotator cuff which required surgery. His medical expenses were $29,163. Medicare was reimbursed $1,617.49. This was settled in mediation.
  • $45,838 settlement for plaintiff. My client was a passenger in a car traveling 95 mph in Stone County . At a curve, the driver ran off the road and overturned. He was treated for a concussion, bleeding in the brain and a fractured lumbar vertebrae. His medical bills were
    $15, 838. The maximum insurance coverage was obtained from the owner of the car. There was no underinsured motorist coverage on the client's own auto policy to maximize his claim.
  • $100,000 settlement for plaintiff The defendant driver was driving too fast under the influence of alcohol with an "undetermined amount of prescription medication".
    He skidded out of control while negotiating a curve in Barry County, crossed the center line striking my client head-on. The driver then fled the scene on foot. In addition to an injury to my client's back and neck, his rotator cuff was torn requiring surgery. He had 5 months of physical therapy. His medical expenses were $23,247. Medicare was reimbursed $2,683 for expenses they paid for treatment.
  • $300,000 settlement for plaintiff My client was a passenger in a car on Highway 39 traveling South. The accident occurred when the North bound company vehicle driven by the defendant employee turned in front of my client. She suffered a fractured hip and required surgery. Her medical expenses were $65,262. Medicaid was reimbursed $3,461 for expenses they paid. This case was settled at mediation.
  • $127,220 Settlement for plaintiff My client was driving a tractor in the North bound Highway 39. The defendant driver attempted to pass the tractor when another vehicle attempted to pass her vehicle. The defendant made impact with the tractor as she attempted to veer back into the North bound lane. This accident aggravated my client's pre-existing conditions of pain in his back. His medical expenses were $47,345. Medicare was reimbursed $3,196 for medical services provided. This case was settled in mediation.
  • $250,000 settlement for plaintiff My client was hit in the driver's side when a company truck ran a stop sign. She was diagnosed with a torn rotator cuff, a ruptured disc requiring surgery. She also had a concussion from a closed head injury resulting in short term memory problems, headaches and dizziness. This case was settled in mediation.
  • $ 125,000 Settlement for plaintiff Upon approaching heavy traffic, my client slowed his SUV that was traveling South on Highway 65. The defendant driver rear ended my client. His neck surgery and medical bills of $55, 261 were a direct result of the collision. The defendant's insurance failed to pay the policy limit of $25,000 as requested by the defendant driver. This resulted in a "bad faith" claim against the insurance policy. This case was settled during mediation.

Wrongful Death

  • $600,000 settlement for survivors My client's 79 year old wife was proceeding thru an intersection with a green light. A semi-truck ran the red light, striking her vehicle killing her instantly. The defendant driver was found to be speeding and in violation of motor carrier rules. She had no medical expenses. This case was settled in mediation before filing suite. Experts used: Accident Reconstructionist, SALT Institute, economists.
  • $570,000 settlement for survivors My client's 60 year old husband was struck by a semi-truck that crossed over the line on a curve. This projected his vehicle into the path of another semi-truck causing his vehicle to be run over by the second semi-truck's rear axle . He died at the hospital where he was air-lifted from multiple injuries to his head, spine, chest, arms and legs. Medicare was reimbursed for $8,913 for the $24,291.44 expenses incurred. A factor in settlement was the fact the deceased was the primary care taker of his disabled wife. This case was settled in mediation.
  • $275,500 settlement This double fatality accident occurred when my client was killed instantly when his truck was struck head-on by the defendant's vehicle crossing over the centerline. The defendant was driving a company vehicle. Maximum insurance limits were recovered from the defendant driver's auto insurance and owner of the auto. A settlement was reached on the second day of a 3 day jury trial from the company's insurance policy. My client was the father of a small child where a portion of the funds will be distributed over his lifetime. Expert used: economists
  • $100,000 settlement for survivors of deceased This three car accident occurred when the defendant driver crossed the center line on a curve on Business 60 Highway. His vehicle struck an oncoming vehicle and hit the decedent's vehicle head-on killing her instantly. The insurance policy from the defendant driver and the owner of the decedent's vehicle paid the maximum amount of insurance limits on this claim. Settlement was reached prior to filing suit.

Premise Liability

  • $527,000 verdict for Plaintiff (slip and fall) - My client slipped and fell in a handicap ramp that was covered in ice as a result of a faulty unmaintained downspout. She ruptured disk C5-6 and suffered an annular tear at L4-5 along with shoulder and foot complaints. This resulted is surgery for an anterior cervical diskectomy and fusion of her neck. Her past medical bills were $80,000. Two pre-trial mediations failed with defense offering $30,000 to settle. The jury gave 25% fault to my client.   • 90,000 settlement for plaintiff (slip & fall) My client fell on at a car wash from poor maintenance of a faulty downspout. He missed several weeks of work due to a hip fracture. His medical expenses were $24,000. This case was settled in mediation.
  • $80,000 settlement for plaintiff (slip and fall) My client slipped and fell on a sidewalk at an apartment complex 2 days after an ice storm. The apartment management failed to correct or warn residents and guest of the hazardous condition. She broke both bones in her ankle requiring two surgeries. She had no medical insurance. At the time of settlement, this office was able to make arrangements with her healthcare providers to reduce her total medical bills of $27,869 by 61 percent. A settlement was reached in mediation .
  • $75,000 Verdict for plaintiff (slip and fall) - My 74 year old client was a customer of Wal-Mart. While checking out, she slipped on a piece of plastic used to display merchandise.
